Lithium Golf (“Manufacturer”) warrants that each Lithium Golf Branded Pack (“Product”) consisting of Lithium Golf branded components; LiFePO4 Battery/Batteries, LiFePO4 Battery Charger sold by authorised dealers in Australia are free of defects in material and workmanship for a period (the Warranty Period”) based upon the Product use application, subject to the following terms.(  Batteries must be registered within 30 days of purchase to activate the  warranty if purchase the battery after 01-03-2024. Batteries must be registered  before 01-10-2024 if purchased battery before 01-03-2024.)

1.     WARRANTY PERIOD

1.1.  Commencement Date

The Warranty Period commences on the earlier of:

·       the date the Product is first installed in the end application; or

·       3 months after the date of purchase of the Product by the authorised dealer from the Manufacturer.

1.2.  Warranty Period

Subject to Clause 1.1, the Warranty Period lasts for the following duration based on the end use application:

·       Private Golf Use — 5 YEARS starting from the Commencement Date for original end-user/owner using the Product solely for their own personal golfing.

·       Commercial and Non-Golf Use — 3 YEARS starting from the Commencement Date for:

o   Commercial Use: original end-user/owner using the Product, whether directly or as part of business operations, for any income-generating purpose, including but not limited to hiring or renting Golf Carts to third parties, operating Golf Carts as part of a hospitality, resort, or transport service, or any other commercial enterprise; and

o   Non-Golf use: original end-user/owner using the Product for purposes other than golfing, including but not limited to use as a mode of transport or utility vehicle on private property, public roads, or public areas, regardless of whether any income is derived from such use.

1.3.  Replacement Products

Where a Product is replaced or supplemented, the Warranty Period is calculated from the Commencement Date of the original product under Clause 1.1 and is not reset or extended. The Warranty will not be revived or extended by reason of any subsequent purchase or installation of additional or replacement Products.

2.     Non-transferable

This Warranty applies only to the original end-user/owner of the Product and is strictly not transferable.

This Warranty will be void including but not limited to the following circumstances:

·       The Product is sold or transferred to any other person or entity, including but not limited to as part of a broader sale of equipment or a vehicle in which the Product is installed;

·       An authorised dealer or any other person removes the Product from one vehicle or application in which it was originally installed and reinstalls it in a different vehicle or application. The Warranty applies only to the original installation. Any such removal and reinstallation will void the Warranty, regardless of whether the reinstallation is carried out for a new customer or existing customer; or

·       The Product is dealt with in a manner inconsistent with continued use by the original end-user/owner in the original installation.

3.     WARRANTY ELIGIBILITY

3.1.  Eligibility

Subject to the exclusions set out in Clause 4, the Warranty applies solely and exclusively to a defect in materials or workmanship in the Product arising solely from the Manufacturer’s manufacturing process.

If this condition is not strictly satisfied, this Warranty does not apply.

3.2.  Scope

This Warranty only covers the Product itself.

The Manufacturer is not responsible for any damage to, or loss affecting, any vehicle, equipment, component, system, structure, or other property in or to which the Product is installed, connected, integrated or used, and is not liable for, and is not liable for any indirect, incidental, special, punitive, exemplary or consequential loss or damage, including but not limited to loss of use, loss of profits, loss of revenue, loss of opportunity, loss of production, or economic loss of any nature, arising from or in connection with the Product or any defect therein.

3.3.  Limitation of Liability

To the maximum extent permitted by applicable law in Victoria:

·       the Manufacturer's liability under this Warranty is strictly limited to the repair, replacement, or substitution of the defective Product at the Manufacturer's sole discretion, as set out in Clause 6;

·       subject to Clause 3.2, the Manufacturer will not be liable for any loss or damage of any other kind, whether direct or indirect, including but not limited to

o   lost profits or revenue;

o   labour costs, installation expenses, or removal costs;

o   shipping, freight, or transportation costs;

o   damage to vehicles, equipment, or other property; or

o   any other indirect or consequential losses of any kind.

 

4.     WARRANTY EXCLUSIONS

4.1 This Warranty does not cover the following circumstances (this list is non-exhaustive):

·       Using components that have not been approved by the Manufacturer as replacement components to those which are supplied in the Manufacturer’s original Product pack.

·       Failure to correctly install the Product or Charger. Installation is the sole responsibility of the authorised dealer or the end-user/owner or third-party professional installer. The Manufacturer will not be responsible for damage due to improper installation, abuse or neglect, including but not limited to loose terminal connections, under-sized cabling, incorrect connections (series and parallel) for desired voltage and AH requirements, installing in reverse polarity or improper fitting, connection, or integration with vehicles or equipment.

·       Failure to properly store the Product. This includes not disconnecting Product from any items that may draw power, and environmental damage due to exposure to extreme hot or cold temperatures.

·       Damage due to over-tightening and stripping of terminals.

·       Damage caused during shipping or mishandling of the Product.

·       Using the Product for any purpose outside it’s intended design, or not in accordance with the user manual or instructions.

·       Incorrect Product size or capacity for the application, for example, insufficient Amp Hours for intended application, the battery kits that has been used more than 80% depth of discharge repeatedly within 24-hour periods etc.

·       Incorrect voltage applied to application.

·       Products that have had the serial number or manufacturing date codes removed or tampered with.

·       Breakage, freezing, wreckage, water damage, melted and broken terminals.

·       Products from which the serial number or manufacturing date codes have been removed or tampered with; Products that have been opened, modified, or tampered with in any way;

·       Using of discharge or test machines;

·       Product damage caused by faulty Golf Cart systems or components, including, but not limited to; motor, computer, controller, solenoid, other items not provided by the Manufacturer’s original Product pack.

  • Where the Manufacturer determines that any Product defect or damage was caused by the end-user/owner, including but not limited to misuse, abuse, neglect, improper storage, or any act or omission by the end-user/owner.

4.2 Illustrative Examples (for reference only and not an exhaustive statement of the exclusions above)

Example 1 — Warranty Replacement with a Different Battery Configuration

In 2020, a customer purchases four 12V 80AH batteries connected in series. In 2024, one 12V 80AH battery fails within the Warranty Period. As the original 12V 80AH configuration is no longer available, the Manufacturer fulfils its warranty obligation under the Warranty by supplying three 51.2V 27AH replacement batteries at its sole discretion.

The Warranty Period for three 51.2V 27AH replacement batteries runs from the Commencement Date of four 12V 80AH batteries in 2020 and is not reset or extended by the replacement. No new or separate Warranty Period arises in respect of the replacement batteries.

Example 2 — Removal and Reinstallation in a Different Cart

A dealer removes a battery from a golf cart that has been in use and installs it into a different cart, whether for a new customer or an existing one. The Warranty is void from the point of removal and reinstallation. The Warranty applies to the original installation only and does not follow the Product if it is moved to a different cart or application.

5.     AUSTRALIAN CONSUMER LAW (ACL)

This warranty is a voluntary manufacturer warranty that is separate from and in addition to any consumer guarantees under the ACL.

6.      HOW TO MAKE A WARRANTY CLAIM

·       Warranty claims are to be made only by an authorised dealer or original end-user/owner of the Product (“Purchaser”).

·       All requests must start by the Purchaser filling out a Technical Support Request (“TSR”) which can be found under support link on the Manufacturer’s website.

o   The TSR will be reviewed and responded to with the necessary technical assistance.

o   The Purchaser will be required to:

1.     Provide original receipt or proof of purchase;

2.     Provide photographs or video evidence of the alleged failure.

·       If technical assistance does not resolve the issue and the Manufacturer deems that the claim may be covered under this warranty, the Manufacturer will send approval for the product be sent to the Manufacturer (“Approval to Send Letter”).

·       The Purchaser is solely responsible for arranging and paying all costs of shipping the Product to the Manufacturer. The Manufacturer requires that:

      1. The Product be shipped using a trackable courier service that provides proof of delivery;

2.     Every box must include the Approval to Send letter, a copy of the TSR and the original proof of purchase. Failure to include these documents will result in the package being returned to sender without assessment; and

      1. The shipment not to be received in damaged condition.

o   Non-compliant shipments may be refused or held at the Manufacturer’s facility until return shipping is arranged or an insurance claim is filed by the Purchaser.

o   If Purchaser requires assistance with shipping the Product to the Manufacturer, the Manufacturer may require a deposit of AUD $250 to cover the cost of return shipping and handling costs.

    • The Manufacturer strongly recommends that all return shipments be fully insured against loss or damage in transit.
    • For the avoidance of doubt, all shipping and transportation costs are borne solely by the Purchaser in all circumstances, whether or not a claim is ultimately covered under this Warranty.

·       Upon receiving the Product, the Manufacturer will test the Product and determine whether the Product is covered under this Warranty. The Product will be covered by the Warranty if the issue satisfies the Warranty eligibility criteria in Clause 3, and is not excluded from the Warranty exclusions set out under Clause 4.

·       Conduct during the warranty claims process

o   The Manufacturer reserves the right to reject any warranty claim and decline further warranty services if:

1.     Any offensive, threatening, or abusive language or conduct is directed at the Manufacturer or its staff, whether in writing, by telephone, or otherwise; or

2.     It was found that the TSR filled in by the Purchaser contains any false or misleading statements.

7.     RESULTS OF TESTING

  • If the Product is tested and is found to be covered under this Warranty:
    • The Manufacturer will, at its sole discretion, repair, replace or substitute the defective Product;
    • All shipping and transportation costs, including but not limited to the cost of sending the Product to the Manufacturer and the return of the repaired or replacement Product to the Purchaser, borne solely by the Purchaser. The Manufacturer accepts no responsibility for any shipping or transportation costs in any circumstances; and
    • The Manufacturer reserves their right to dispose of the Product if it is not collected within 60 days of notification of the assessment result.
  • If the Product is tested and is found not to be covered under this Warranty:
    • The Purchaser will be responsible for all shipping and transportation costs of arranging the return shipping and collection of the Product; and  
    • The Manufacturer reserves their right to dispose of the Product if it is not collected within 60 days of notification of the assessment result.

·       Refunds will not be provided under any circumstances.

8.     WARRANTY DISCLAIMER

·       This warranty is in lieu of, and the Manufacturer disclaims and excludes, all other express warranties not specifically set out in this warranty.

·       To the maximum extent permitted by law and relevant regulations, the Manufacturer limits the duration of all statutory, express, or implied warranties, including without limitation any warranty of merchantability or fitness for a particular purpose, to the Warranty Period.

·       Except for the warranty expressly set above in this warranty and subject to the Australian Consumer Law, the Manufacturer makes no warranty whatsoever with respect to the Products, including any: (a) warranty of merchantability; or (b) warranty of fitness for a particular purpose; whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise.

9.     GENERAL PROVISIONS

·       Governing Law: This warranty is governed by the laws of Victoria, Australia.

·       Severability: If any provision of this warranty is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

·       Entire Agreement: This warranty constitutes the entire agreement the Manufacturer, authorised dealers, and the end-user/owner regarding warranty coverage for the Product and supersedes all prior representations, warranties, or agreements.
